Should I fight this ticket???
Hello. Jus wanted some insight or opinion about my recent speeding ticket. Here is my story. i was actually driving on a two lane road somewhere in the foothills in the northern part of california. it was about 1 a.m. At the time, i wasnt real sure about the speed limit because i had not seen any signs indicating maz speed so i was assuming it was 55mph. i usually travel this road at around that time occationally because there is a local casino i was heading to so i was pretty experienced at driving this road at the time it was. the car i was driving was a 2007 hyandai elantra. i do have a cobra radar detector in the windshield of my vehicle. at the time there hadn't been a car driving in either direction of me being it was soo late in the morning, i figured there wasn't going to be so i had my cruise control set on 65. probably shouldnt have because the limit was 55 but like i said i was very accustomed to the raod and it being so late i really didnt think much of it. as i was driving, all a sudden 2 car came around the corner traveling in the opposite direction of me. i noticed that the second car heading in the opposite direction was somewhat tale-gating the front car. as the front vehicle passed me my radar quickly went off indicating it had picked up a radar presence in the area. it was pretty open and i didd not notice any police vehicle any distance in front of me. as the cars drove by, i watched in my rearview mirror the tale-gating car had done a u-turn and was comming after me. at this point i actually got kind of scared because this vehicle was traveling pretty fast and it almost seemed like kids doing something stupid early in the morning harrassing drivers. as the car approached me from the rear my detector suddenly went off again. i didnt know what it could have been. my thoughts now were either there was something in front of me...or this vehicle was a law enforcement vehicle. this whole time i still had my cruise control set on 65. the vehicle stayed behind me for 20-30 sec before it flashed lights indicating it was in fact a police vehicle. i pulled over to the right shoulder, and waited for the trooper to to approach my window. The trooper indicated to me that he had clocked me going at a speed of 72 mph. as i was shuffliing for my id i was puzzled at his statement that i was traveling at a speed of 72. the thought crossed my mine that yes. i was over the 55 mph limit. but i kno i was not traveling 72, espcecially when i had my cruise control on. I asked the trooper if he was sure i was traveling 72 when he clocked me. i stated that it was odd because i had my crusie control set at 65. He then changed his statement that he saw me going 72, but he pulled me over going 65, when he first indicated that he had clocked me. as he went to the rear of the vehicle i started thinking what had happend before he had pulled me over. My radar usually indicated radar detected a good 1/2 to 3/4 of a mile down the raod but didnt go off until both vehicles were passed me traveling in the opposite direction. and in fact if it was true that he had clocked me while he was moving, how was it he was able to pick up an accurate reading while there was a object in front of him, keep his eyes on the road, and record how fast i was going. as he came back and handed me the ticket i was really puzzled at that point. i should have been more berval but it was late, and i really didnt want to getinto a verbal debate with an officer at the time it was. once he hands u the ticket there really isnt much u can say to get out of it. as we drove away, my gf, who was in the passenger seat at the time was reviewing what the officer had written down. she pointed out something very interesting that confirmed my suspicion to whether or not i should do something about the ticket in court. as i stated in the beginning, the car i was driving was a 2007 hyandai elantra. the officer had written the decription of the car as being a sonata. he also had written my lisence plate number down incorrectly as well. im surprised he got my personal info down right given the mistake he did on my copy. this jus confirmed to me that i had to do something about this ticket. When it came in the mail, the fine was a whopping $442.00!!! i was furious. the officer stated later he did only get me going 65 mph, that was the reason he pulled me over, on the ticket it stated 72 mph. he had gotten my information down wrong on my ticket. The fact that he was driving in the oppostie direction behind another moving vehicle, how can there be enough time to accurately clock me even if he was using the new laser devices. there still was no clear path. everything is a mess right now and i already know that im going to try and fight this ticket. if there are any comments or strategies or tips i am all ears!!! |
